An Appeals Court has turned down, 3-0, NRA’s appeal over closure of NY gun stores during the pandemic. The attorney who alerted us to today’s ruling said there were a lot of “new guy” mistakes made. The suit was filed by NRA alone, rather than NRA plus a few members. But NRA as a corporation wasn’t hurt by the gun store closures, its members were. They didn’t ask for damages, so the case was moot once the regulations were withdrawn. Simple things that would have stopped getting dismissed, and then losing again on appeal. “They gave a Second Amendment case to a lawyer who’d never handled one, and paid the price.”
We’ve previously noted that NRA’s legal team has set a remarkable record for losing its cases. Add one more. Of course, rapper 50 Cent could tell us something about that.
