NY Case: Jury Trial

The judge asked how to try the NY case with a jury (which both sides requested) and this is NRA’s response. It looks like they want more tried to the jury than New York does.

If we read this correctly, it is more insanity. This judge has been quite fair. But NRA (and the individual defendants) want to have a maximum jury trial, in front of a Manhattan jury! That’s insane.

  1. As my wife just said to me, they (Brewer’s team) don’t care if they win or loss since they get will paid regardless. She is correct.

    I’m fairly sure the legal cost to the NRA of a jury trial will be even more than arguing before Judge Cohen.

    1. i’d agree. It really seems like they are deliberately trying to bleed the NRA dry so there is nothing left when Wayne and company get ousted.

  2. Probably because with a jury it may be easier to find grounds to appeal any rulings against the NRA by finding “fault” or “bias” with a juror. Thereby continuing the cash flow for Brewer. (I wouldn’t be surprised if a percentage of Brewers take somehow eventually ends up in LaPierre’s bank account.)

  3. Wow… Nine pages from a $1,400 per hour attorney giving detailed reasons why the judge must allow a jury trial, as guaranteed under NY law and the 7th Amendment to the US Constitution. The letter itself seems excessive, then you consider what the letter is demanding — a jury trial in which a Manhattan jury will decide whether the AG’s very solidly put together case against the NRA is valid and the NRA is the bad guys. What could possibly go wrong.
    The only reasons I could imagine for this, especially in light of Justice Cohen’s extremely fair handling of this whole mess so far, is either they are going to request a change of venue to get out in the sticks of up-state NY where the NRA isn’t hated quite so much (I have no idea whether this is even possible), or an excuse in advance so when they lose they can claim that it’s because of the jury being made up of NRA-hating New Yorkers.
    I’m still amazed they haven’t yet filed for bankruptcy again or tried to settle before trial. They still have a couple of months to pull something like that, so stay tuned.
    By the way, have you seen that NRA apparently has another suit going against Ackerman McQueen? The whole thing appears to be being done in secret for some reason, so no reliable information is available.
